From offer to completion

You have found the property you want to buy and your offer has been accepted. From now and until and after completion of the purchase, the lawyer will take care and assist you in all of the different steps involved in the transaction of buying or selling property in Spain.

It will be the responsibility of your appointed lawyer to discuss the purchase terms with the seller’s lawyer - terms which should cover all of your requirements, such as completion date, the form of payment, and many other things beyond just the price.

From the beginning your lawyer will review, advise and execute many aspects of the purchase, ensuring that the property is legally registered in the Vendors name, that the property is free of any mortgages, any charges, encumbrances, debts or any other liabilities. Once the reservation deposit is paid, the lawyers has a responsibility to examine and witness, in writing, the terms of purchase before drawing up the private contract. The lawyer will also undertake searches and investigations into all aspects of the property and land before the exchange of contracts takes place.

On the day of completion, your lawyer will go to the Notary Public to sign the title deed, make the final payment to the Vendor and take possession of the keys, handing the property over to you. To ensure that the notary and the land registry act together to protect and guarantee your interests and to prevent the property being sold twice, the notary will fax details of the title deed to the local land registry at the stage the sale is completed. You will be responsible for ensuring the original title deed is submitted to the land registry.

Finally, you will have to pay any relevant taxes, whilst your lawyer assists you with the transfer of utilities into your name and organise their payment through a local bank.
