THE PROPERTY
Where you are a client or wish to engage with us as a client on this site to promote and market your property for sale ("Seller"), we will act as your agent in respect of your property ("Agent"). As your Agent, we will promote and market the property on our site, based on the information that you provide to us ("Services").
It will be solely your responsibility to ensure that the information you provide to us about your property is accurate and any statements or information provided, whether written or oral about the property is accurate and not misleading.
When providing information about the property, you will tell us whether the property is owned by you in full, or part, and whether the property is to be sold free of charges and encumbrances. As your Agent we take no responsibility for the accuracy of the information provided.
All information provided about your property will be uploaded by you. We take no responsibility for any failure to upload information or pictures to our site. We will not take responsibility for any defects of work undertaken whilst marketing the property.
Once the property has been sold by any means, other than through the Agent, you must notify us immediately.
You acknowledge that you are solely responsible for the use of our site, for the information you provide about your property and for all the results obtained. You acknowledge that all warranties, representations, conditions and undertakings whether express or implied are executed to the fullest extent permitted by law.
Expect for liability for death and personal injury arising out of negligence wilful misconduct or fraudulent misrepresentation, we do not accept any liability for any loss or damage incurred by you. You will be responsible to us and make good to us any loss or claim or damages that we suffer as a result of providing services to you as a client, your use of this site (including access or in-access), or any information or anything else related to or arising from your property.
UPLOADING MATERIAL TO OUR SITE
Whenever you make use of a feature that allows you to upload material to our site, or to make contact with other users of our site, you must comply with the content standards set out in our acceptable use policy found here. You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty.
Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. ACCESSING OUR SITE
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
MARKETING
Our marketing material will be based on the information and uploaded data that you provide us, and therefore, you acknowledge that as Seller you assume all responsibility for the accuracy of the information to be included on the our site and that of any partner or associated site.
The Seller must notify in writing their intention to remove or suspend their property from the Agents websites; properties removed from the websites for whatever reason that are re-submitted at a later date, will be charged at €49.00 + IVA re-registration and administration fee.
RELIANCE ON INFORMATION POSTED
Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.
OUR SITE CHANGES REGULARLY
We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
TERMINATION
This agreement has no fixed term. The client has the right to cancel using our Services at any time, providing 30 days, notice in writing before termination of the Services. Where a monthly payment package is initiated, these are not permitted to be cancelled mid-term.
REFUNDS, DOWNGRADES OR CHANGES
Refunds, Downgrades, or Changes within 24 Hours of your Purchase. You can obtain a refund, downgrade your plan with a refund of the difference in price, or change your plan within 24 hours of your purchase by notifying Mejor Me Alquilan S.L. in writing of your refund request, downgrade request, or change order.
For a change that involves an upgrade to a plan, you must pay the difference in price between the plan you initially purchased and the upgraded plan.
FOR ANY REFUND OBTAINED, MEJOR ME ALQUILAN S.L. HAS THE RIGHT TO CHARGE A €20 CANCELLATION FEE FOR SERVICES RENDERED.
PAYMENT
Where we provide with you with our Services, you agree to pay any second or final payment due to the Agent at the point a sale is agreed for the property and a deposit received, and not at the point of completion at the Notary. Payments for monthly packages (as detailed on site) will be taken in advance of each month and paid for through our site.
Additional Services
We are happy to provide additional services in addition to the main Services that we provide. Where you feel this is necessary, please contact us and we will discuss this with you. Such additional services may include a home visit, a video of their property, the inclusion of floor plans in their marketing materials and sometimes the inclusion of an Ariel photograph of their property. If you require these additional services, please speak to us and we will be happy to discuss a pricing based on your individual needs.
Please note that we do not accept responsibility for collecting or delivering keys from or to the Seller at their property. Keys can be forwarded to or collected from the Agents office in Sucina.
A "For Sale" sign will be provided to the Seller if this is included in their package price. Any additional signs requested, will be posted to the Seller at a price of €49.00 +IVA.
If you require additional appointments with us as you Agent, other than those listed in their package agreement, we will be happy to conduct these at the company's office in Sucina.
We offer a free accompanied viewing service for all properties located within the region of Murcia and the region of Alicante for clients that have purchased our Sell €499 package. For properties located further afield, we can still arrange an accompanied viewing services for a fee, the price of which will be dependent upon where the property is located. If you require this additional service, please speak to us and we discuss arrangements and fees with you.
We will arrange to meet potential buyers at the appropriate property and show them around. Please note that we are not responsible for ensuring that you or potential buyers are at the property for the viewing or other appointments. Each person is responsible to make their own way to any appointment that we arrange,
We can also provide an after sales service which may include meeting the bank to allow for a valuation of the property, obtaining copies of paperwork and anything else that may have been associated with the sale. A quote is available on application and prices will be dependent on where the property is located and the services required.
INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
